But did you know that OSHA`s jurisdiction varies from state to state? The federal OSHA has authorized 25 states, Puerto Rico and the Virgin Islands to manage their own health and safety services. In these so-called state planner states, the program is state-run but jointly funded by the state and the federal government. State plans must be at least as effective as OSHA, but some states, such as California, have opted for stricter standards. Kentucky OSH cited the plant for 16 „serious“ violations for a total of more than $100,000 in fines. After the factory`s lawyer promised to challenge any infringement in court, Kentucky OSH dismissed all violations in 2008 and found that „the case would not have faced a legal challenge.“ Instead, Kentucky OSH and the plant entered into a transaction agreement in which the plant agreed to improve safety and the agency would conduct follow-up inspections. Employers working in a state of the plan can find, on www.osha.gov/dcsp/osp/index.html, a quantity of information about the health and safety laws of that state. Government plans for the private sector must also include workers in public and local communities. OSHA rules also allow states and territories to develop plans that cover only public sector workers (the state and municipalities). In these cases, employment in the private sector remains the responsibility of the federal OSHA.

Twenty-two states and territories carry out comprehensive plans and four cover only the public sector. These statements are listed below and on the OSHA website. State plans are OSHA-approved health and safety programs, which are managed by individual states instead of the federal OSHA. The Occupational Safety and Health Act encourages states to develop and implement their own occupational health and safety plans and excludes state enforcement of OSHA standards unless the state has an approved plan. OSHA approves and oversees all government plans. State plans must be at least as effective as the requirements of the OSHA of the Confederation. In four of these sites (Connecticut, Illinois, New Jersey, New York and the Virgin Islands), the government plan applies only to public sector workers; Private sector employers are still covered by the federal OshA. In other states of the state plan, the state is responsible for both public and private employers. If you are on any of the above sites, you cannot consider that compliance with OSHA`s federal rules will be sufficient.

While OSHA`s federal rules set a minimum standard for all government plans, some states have added additional requirements or have chosen different approaches to enforcement and fines. In addition, national programmes often implement unique programs, outreach efforts and training opportunities. After learning of the case`s rejection, a concerned citizen filed a formal complaint against Kentucky with the Federal OSHA. In 2011, it found that Kentucky OSH had erred in dismissing the case.
